Who We Are
FactoryDesk AI is an AI-powered software platform for factory and industrial operations management. We offer tools for production monitoring, predictive maintenance, inventory forecasting, and automated reporting. Our services are provided through our website at factorydeskai.com and our cloud-based platform.
These Terms form a legally binding agreement between you (and your company) and FactoryDesk AI. References to “we,” “us,” or “our” mean FactoryDesk AI. References to “you” or “your” mean you personally and the organization you represent.
Using Our Services
To use FactoryDesk AI, you need to create an account. Here is what that means:
Eligibility
You must be at least 18 years old and have the legal authority to enter into agreements on behalf of your organization. By signing up, you confirm that both of these things are true.
Account Responsibility
You are responsible for keeping your login credentials secure. Do not share your password with anyone who is not authorized to use the platform on your behalf. If you think your account has been accessed without permission, contact us immediately. You are responsible for everything that happens under your account.
Accurate Information
When you sign up, please provide accurate and complete information. If your details change, update your account. We rely on accurate information to provide you with the right service.
Acceptable Use
You agree to use FactoryDesk AI only for lawful purposes. You may not use our platform to:
- Violate any laws or regulations
- Reverse-engineer, copy, or reproduce any part of our software or technology
- Attempt to gain unauthorized access to our systems or another user’s account
- Upload harmful code, malware, or anything that could damage our platform or other users
- Misrepresent yourself or your organization
- Use the platform to harm, harass, or deceive others
Subscription Plans and Payments
FactoryDesk AI offers several pricing plans to fit different business sizes and needs.
Plans Available
- Starter ($499/month) — Ideal for small facilities, includes 5 connected machines and basic monitoring
- Professional ($1,299/month) — For mid-sized plants, includes 25 machines and predictive maintenance AI
- Enterprise (Custom pricing) — For large, multi-plant operations with unlimited machines and full integrations
Billing
Subscriptions are billed monthly or annually depending on the plan you choose. By providing your payment information, you authorize us to charge your payment method on a recurring basis. All fees are in US dollars and are non-refundable unless otherwise stated.
Free Trials
We may offer a free trial for new customers. At the end of the trial period, your subscription will automatically convert to a paid plan unless you cancel before the trial ends. We will remind you before this happens.
Price Changes
We may change our pricing from time to time. We will always give you at least 30 days’ notice before any price increase takes effect for your account.
Late Payments
If a payment fails, we will notify you and give you a grace period to update your payment details. If payment is not resolved, we may suspend or terminate your account. Any amounts not paid when due may accrue interest at 1.5% per month or the maximum rate allowed by law, whichever is lower.
Your Data and Our AI
You own your data. When you connect your machines and feed operational data into FactoryDesk AI, that data belongs to you. We do not claim any ownership over it.
You grant us a limited license to use your data to deliver the services you have subscribed to — including running our AI models, generating predictions, and creating your reports. We do not sell your data to third parties or use it to train models for other customers without your consent.

Intellectual Property
Everything that makes FactoryDesk AI what it is — our software, AI models, platform design, brand, documentation, and content — belongs to us. These Terms do not give you any ownership rights in our technology or intellectual property.
You are granted a limited, non-exclusive, non-transferable license to use our platform for your internal business purposes while your subscription is active. That license ends when your subscription ends.
If you provide us with feedback, suggestions, or ideas about how to improve our product, you give us the right to use those ideas freely without any obligation to compensate you.
Service Availability and Support
We work hard to keep FactoryDesk AI running reliably. Our platform is hosted on secure cloud infrastructure with high availability. However, we cannot guarantee 100% uptime. There may be periods of scheduled maintenance, unexpected outages, or performance issues beyond our control.
We will notify you in advance of any planned maintenance that may affect your service. If there is an unexpected outage, our team will work to restore service as quickly as possible.
Support is available according to your plan level:
- Starter: Standard email support
- Professional: Priority support with faster response times
- Enterprise: Dedicated Customer Success Manager
Cancellation and Termination
You Can Cancel Anytime
You can cancel your FactoryDesk AI subscription at any time by contacting us or using the cancellation option in your account settings. Cancellation takes effect at the end of your current billing period. We do not offer refunds for unused time in the current billing period, but you will continue to have full access until your subscription expires.
We May Suspend or Terminate Accounts
We reserve the right to suspend or terminate your account if you violate these Terms, fail to pay your subscription fees, or if we believe your use of the platform is harmful to others or to us. We will give you notice and a reasonable opportunity to fix the issue whenever possible.
What Happens to Your Data After Cancellation
After your account is closed, we will retain your data for 90 days, during which time you can request an export. After that period, your data will be deleted from our systems in accordance with our Privacy Policy.
Limitation of Liability
We want FactoryDesk AI to help you run a better factory. But we also need to be honest about limits.
Our platform provides predictions and recommendations based on AI analysis. These are meant to support your decision-making — not replace the judgment of your experienced team. We are not liable for operational decisions you make based on insights from our platform.
To the maximum extent permitted by law, FactoryDesk AI’s total liability to you for any claims arising from your use of our services will not exceed the amount you paid us in the 12 months prior to the claim. We are not liable for any indirect, incidental, special, or consequential damages — including lost profits, lost data, or business interruption — even if we were advised of the possibility of such damages.
Disclaimer of Warranties
FactoryDesk AI is provided “as is” and “as available.” We make our best efforts to deliver a reliable, accurate, and valuable platform. However, we do not make any warranties, express or implied, that our services will be error-free, uninterrupted, or that any predictions or recommendations will be accurate in every situation.
Industrial environments are complex, and AI works best with quality input data and trained operators. We encourage you to use our platform as a powerful tool alongside — not as a replacement for — your existing expertise.
Indemnification
By using our platform, you agree to defend, indemnify, and hold harmless FactoryDesk AI, its team members, and its service providers from any claims, damages, or expenses (including legal fees) that arise from:
- Your use of the platform in violation of these Terms
- Your violation of any applicable law or regulation
- Your infringement of any third party’s intellectual property or other rights
- Any content or data you upload to the platform that harms others
Changes to These Terms
We may update these Terms from time to time. When we make significant changes, we will notify you by email or through a notice on our platform at least 14 days before the changes take effect. Continued use of FactoryDesk AI after the updated Terms take effect means you accept the new Terms.
If you disagree with a change, you can cancel your subscription before the new Terms take effect.
Governing Law
These Terms are governed by the laws of the United States. Any disputes arising from these Terms or your use of our platform will be resolved through good-faith negotiation first. If a resolution cannot be reached, disputes will be handled through binding arbitration, except where prohibited by law.
